These Terms of Service ("Terms") govern your use of CheerDay ("the app", "we", "our"). By using CheerDay, you agree to these Terms. If you do not agree, please do not use the app.

CheerDay is a mobile application that helps you remember and celebrate the birthdays of people you care about. The app allows you to:

• Store names, birthdays, and phone numbers of your contacts
• Receive push notifications reminding you of upcoming birthdays
• Send birthday wishes via WhatsApp
• Sync your data across devices (with an account)
• Share and import contact lists with other CheerDay users

The app is provided free of charge. We may introduce paid features in the future, which will be clearly identified before any purchase.

• You can use CheerDay without creating an account for basic local functionality.
• To sync data or share contact lists, you need to create an account using your phone number.
• You are responsible for keeping your device and account secure.
• You must provide a valid phone number. Accounts created with fraudulent or fake numbers may be terminated.

When using CheerDay, you agree not to:

• Use the app for any unlawful purpose
• Store contacts without their knowledge for purposes other than birthday reminders
• Attempt to access other users' data or accounts
• Reverse-engineer, decompile, or tamper with the app
• Use automated tools (bots, scrapers) to interact with the app
• Distribute spam or unsolicited messages through any feature of the app
• Upload malicious content or attempt to compromise the app's infrastructure

We reserve the right to suspend or terminate accounts that violate these terms.

You own the data you enter into CheerDay (contact names, birthdays, phone numbers). We do not claim any ownership over your data.

By using the sync feature, you grant us a limited license to store and transmit your data solely for the purpose of providing the service. This license ends when you delete your account.

• The CheerDay app, including its design, code, logo, and branding, is our intellectual property.
• You may not copy, modify, distribute, or create derivative works based on the app without our written permission.
• The name "CheerDay" and associated branding are our trademarks.

• We aim to keep CheerDay available at all times, but we do not guarantee uninterrupted access. Maintenance, updates, or technical issues may cause temporary downtime.
• We may update the app at any time. Some updates may be required to continue using the service.
• We may discontinue the app or specific features with reasonable notice.

CheerDay is provided "as is" without warranties of any kind, either express or implied.

• We are not liable for missed birthday reminders due to device settings, network issues, or other factors outside our control.
• We are not liable for any data loss. We recommend keeping your own backup of important dates.
• We are not responsible for the content of messages you send through third-party apps (such as WhatsApp) using information from CheerDay.
• To the maximum extent permitted by law, our total liability for any claim related to the app is limited to the amount you paid us in the 12 months prior to the claim (which may be zero for free users).

• You can stop using CheerDay at any time by uninstalling the app.
• You can delete your account from the Settings screen to remove all your data from our servers.
• We may suspend or terminate your access if you violate these Terms, with or without notice depending on the severity of the violation.

We may update these Terms from time to time. If we make significant changes, we will notify you through the app. Continued use of CheerDay after changes take effect means you accept the updated Terms.

These Terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to the competent courts.
